The debate about the legality of Daily Fantasy Sports has been taken up by the state governments of many jurisdictions in the USA. In the newest piece of information, the legal status of Illinois has been put out in the open. It was declared by the Attorney General Lisa Madigan that DFS illegal gambling is illegal under state law. Following this, two of the biggest DFS operators, DraftKings and FanDuel, immediately sued the Attorney General asking the courts to find her opinion in error. To this Madigan replied by filing motions so as to dismiss the lawsuits filed by these companies.
It is still maintained by Madigan that the complaints by operators are “barred by sovereign immunity”. She says that this is so because it is well within her constitutional and statutory powers to issue legal opinions. She finds the complaint erroneous and says that issuing her opinion “did not violate any law.” Madigan goes on to say that the operators in question have not provided the court with any facts to explain that the businesses experienced the “concrete hardship necessary to convert their disagreement with the Opinion into a ripe justifiable controversy.”
Daily Fantasy Sports, in general has been seeing a lot of opposition in its way. As of now, there is a big number of groups opposed and that is so for Daily Fantasy Sports betting in their particular jurisdiction.
